1. Introduction
1.1. Welcome to the website of Imad Money Transfer, where you can review the terms and conditions under which we provide money transfer services (the Services). The term 'Services' includes money transfer services, money remittance services, international money remittance services, and Payment Services in accordance with Schedule 1 Part 1 of The Payment Services Regulations 2009 & 2017.
1.2. Before confirming your order, please:

  • Read these terms and conditions (the Conditions) and our cancellations and refund policy.
  • Print a copy for future reference.
  • Read our privacy policy regarding your personal information.

1.3. By ordering any of the Services listed on this Website, you agree to be legally bound by these Conditions. Please read these terms and conditions carefully as they may be modified or amended from time to time. Acceptance of these terms & conditions is mandatory for signing up for an account.
1.4. We reserve the right to revise and amend the Website, our disclaimers, and the Conditions at any time without notice to you. Your continued use of the Website following a change shall be deemed acceptance of such change. Major changes will be flagged clearly on the Website if deemed necessary.
2. About Us
2.1. This Website is owned and operated by Imad Money Transfer (we/us/our), a private limited company registered in England and Wales. Registered office: 423 Kingsbury Road, London, NW9 9DT.
2.2. We are registered with the Financial Conduct Authority (FCA) and HM Revenue & Customs to carry out Money Transfer Activities in accordance with Payment Services Regulations 2009 & 2017.
3. Communications
3.1. You agree that email and other electronic communications can be used as a means of communication and acknowledge that all contracts, notices, information, and other communications provided to you electronically comply with any legal requirement that such communications be in writing.
3.2. We will contact you by email or provide information by posting notices on our Website.
4. Overseas Orders
4.1. Our Website is intended for use by customers who are residents in the United Kingdom.
4.2. If we agree to supply any Services for delivery outside the United Kingdom, they may be subject to additional fees, duties, and/or taxes or expenses incurred due to local regulatory requirements. You will be responsible for payment of any such duties and/or taxes in addition to our price.
4.3. You must comply with all applicable laws and regulations of the country for which the Services are destined.
5. Registration
5.1. After signing up on the Website or using our Mobile app, you are responsible for keeping your login credentials secret.
5.2. By signing up for an account, you undertake the following:

  • All provided details (Name, Address, Nationality, DOB, Occupation, and Identification details) are true, accurate, current, and complete.
  • Update your information in your profile or contact us for necessary amendments before initiating any further payment.
  • You are 18 years or older, or if under 18, you have a parent or guardian’s permission to register and purchase the Services.
  • Only use the Website/Mobile app with your own username and password.
  • Keep your login credentials secret and change your password immediately if you notice any unusual activity on your account.
  • Provide us with correct and truthful details regarding the money remittance transaction or transactions, the payee or beneficiary’s details, your full name, address, bank account number, and any other information we request.

5.3. You authorize us to transmit your personal information to obtain information from third parties, including credit reports, to authenticate your identity.
5.4. We reserve the right to terminate your agreement and suspend or terminate your access to the Website if:

  • You fail to make any payment to us when due.
  • You breach these Conditions.
  • You impersonate any other person or entity.
  • You fail to provide sufficient information to determine the accuracy and validity of the information supplied by you.
  • We suspect you have engaged in fraudulent or illegal activity on the Website.

6. Eligibility to Purchase from the Website
6.1. To purchase the Services, you must:

  • Be 18 years of age or over.
  • Be legally capable of entering into a binding contract.
  • Provide full details of an address in the United Kingdom or the European Economic Area (if you reside in the EEA) or your local country address for the performance or delivery of the Services.

6.2. If you are under 18, you may only use the Website under the supervision of a parent or guardian.
6.3. Identification requirements for Online Payment:

  • Valid Photo identification (Passport or Driving License).
  • Address Verification (any valid utility bill/bank statement or council tax bill within the last 90 days).
  • Your complete contact details.

6.4. Imad Money Transfer is authorized to verify your provided documents for identification purposes with an independent online source.
7. Price
7.1. The prices of the Services are quoted on the Website.
7.2. Prices quoted are for performance of the Services in the United Kingdom unless otherwise specified.
7.3. Prices quoted exclude VAT (we are not VAT registered).
7.4. We reserve the right to increase the price of the Services to reflect any increase in cost due to factors beyond our control. You shall be entitled to cancel the order if we increase the price before commencing the Services.
8. Payment
8.1. Payment can be made by major personal (not commercial) prepay, credit, or debit card or through an electronic payment account as explained on the order form. Cash payment can be made at the branch.
8.2. By placing an order, you consent to payment being charged to your account.
8.3. Payment will be debited and cleared from your account before the provision of the Services.
8.4. We carry out certain checks when you pay by card, including obtaining authorization from your card issuer for security reasons.
8.5. By accepting these Conditions, you undertake that:

  • All details you provide for purchasing the Services are correct and the payment card you are using is your own.
  • Any Services ordered are for your own private or domestic use only and not for resale.
  • You authorize us to transmit your payment and delivery information to obtain authorization from your card issuer.

8.6. We will contact you if there are any problems with the authorization of your card.
8.7. We will take all reasonable care to keep your order and payment details secure but cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide.

 

9. Order Process and Formation of a Contract
9.1. All orders are subject to acceptance and availability. If any Services are not available, you will be notified by email.
9.2. Any order placed by you constitutes an offer to purchase the Services from us. We reserve the right to refuse any order placed by you at any time prior to acceptance.
9.3. You are responsible for ensuring the accuracy of the details provided during the order process.
9.4. Communication acknowledging receipt of your order does not amount to acceptance of your offer.
9.5. A contract will only be formed when we send you a Confirmation Notice after debiting your payment card and confirming the provision of the requested Service.
9.6. You must check that the details in the Confirmation Notice are correct and keep a copy.
9.7. You will be subject to the version of our policies and Conditions in force at the time you order the Services unless otherwise agreed.
9.8. We also accept orders from agents on behalf of customers. The resulting legal contract is between the Agent and us.
10. Delivery
10.1. Transactions will be ready to disburse on our pay-out network where the receiver can show their ID. Additional documents may be required subject to Compliance policies and procedures.
10.2. Any dates quoted for completing the service are approximate. If no date is specified, it will take place within 30 days or a reasonable time of the Confirmation Notice.
10.3. We shall not be liable for any delay in completing the Service, however caused.
11. Cancellation and Refund
11.1. If you have any problems with the Service, contact us using the contact information at the bottom of these Terms and Conditions.
11.2. You have the right to cancel your agreement within fourteen days after submitting the transaction, or until we have completed the contract by paying the Pay-out Amount to the Recipient, whichever is earlier. A cancellation charge may apply.
11.3. Written requests for a refund must include the Sender’s full name, address, phone number, Transaction identification number, Transaction Amount, and reason for the refund request.
11.4. Refunds will be credited back to the same Payment Instrument used to fund the Transaction and in the same currency.
11.5. Refunds will only cover the Transaction Amount if the Transaction was not paid out to the Recipient; otherwise, only the Transaction Fee will be refunded.
11.6. A charge of £20 may be applied, which will be deducted from the transaction amount on top of the transaction fee.
12. Data Protection
12.1. Personal data supplied to us is protected by GDPR rules and used for performing our Services, assessing risk, and enforcing our rights under these Terms and Conditions.
12.2. We may disclose your Personal Information if required by law or requested by regulatory authorities investigating suspected illegal activities.
12.3. Our data protection officer is Shoaib Wazirzai, registered with I.C.O.
13. Intellectual Property and Copyright
13.1. All intellectual property rights in the Website, content, design, and layout are owned by us or our licensors.
13.2. You are granted a non-exclusive, revocable license to use the Website for your personal use only. You must not copy, distribute, or publish any part of the Website.
14. Limitation of Liability
14.1. We shall not be liable for any indirect or consequential loss or damage.
14.2. Our liability to you for any loss or damage arising in connection with this agreement shall not exceed the total transaction amount.
15. General
15.1. These Conditions and our policies constitute the entire agreement between us and you.
15.2. If any part of these Conditions is unenforceable, the enforceability of any other part will not be affected.
15.3. These Conditions are governed by English law and you agree to submit to the exclusive jurisdiction of the English courts.
